steinar ist right. Audio with a loudness below -23,5 LUFS is not compliant to R128. However there is a specification for lower programme loudness, i.e. when the programme consists mainly out of background sounds. EBU recommends setting a "loudness offset" and/or a "low loudness flag" for those cases in their production guidelines (EBU Tech 3343). But I did not come across the use for those very often.
